These Terms and Conditions govern the relationship between you, the passenger, and us; Eco Planet Adventure, LLC, - the Operator. You agree to be bound by these Terms and Conditions. They State, among other things, our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum, and jurisdiction; please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations. We strongly recommend you purchase travel protection.
Early reservations are encouraged to confirm your space in our Adventure trip. Reservations are accepted after we receive the initial deposit with a Reservation Form signed by each adult 18 years or older. An initial deposit of $500 per person is required to secure your reservation. To secure reservations on a trip departing within 60 days, a full payment is required at the time of booking.
Final payments are due 60 days before departure. Failure to deliver complete payment 60 days prior to departure will be considered notification of cancellation by default and is subject to cancellation charges as stated below
Every effort has been made to produce pricing information accurately. Operator reserves the right to correct promotional or pricing errors, or to increase the Trip Price in the event of cost increases due to changes in local airfares, currency fluctuations, park fee increases, changes in group size or rooming status, taxes, or fuel surcharges, or other reasons, unless you pre-paid the full cost of the trip prior to the cost increase going into effect.
Initial deposits may be made by check or VISA, MC or AMEX. The balance is payable by check or credit card.
Eco-Planet Adventure, LLC. [hereafter referred to as EPA, LLC.] reserves the right to deny participation to anyone whom it deems unsuitable for a trip.

TO SIGN UP FOR THE TRIP: You may charge your initial deposit by phone Visa, MasterCard or American Express. We will hold your space for one week until the complete Reservation Form is received.
BY MAIL OR FAX: Complete the Reservation Form and mail or fax it with your deposit. If you book through a travel agent all subsequent communication will be made through your agent.

- Adventure Group Program: Adventurers who will sign up for the trip as one group of 8 will receive a group discount of $1,000.00 ($125.00 each).

- You earn $100 in ‘Adventure Credits’ per person when your new Adventurers returns back from their first Expedition.
- Upon referring 4 adventurers within one calendar year, your credits will increase; you'll be rewarded with $150 in ‘Adventure Credits’ for each adventurer you refer for the rest of the year.
- The new Adventurers referred by you will enjoy a $100 ‘Adventure Discount’ on their first Adventure expedition with us.
It is important to note that:
- New Adventurers that are joining a trip together with the person that referred them will earn the ‘Adventure Discount’ only if the referring person has been already on a prior expedition with us.
- In matter to ensure that proper ‘Adventure Credits’ and ‘Adventure Discounts’ are applied, your new adventurers must provide your full name and address upon booking their first expedition.
- We will issue the ‘Adventure Credits’ when your new Adventurers return.
- Our ‘Adventure Credits’ and ‘Adventure Discounts’ are designed for the referred individuals only and cannot be combined with our Adventure Group Program.
The ‘Adventure Credits’ and ‘Adventure Savings’ are non-transferable, and are valid for one year from date of issue

In the event we are able to accept a booking less than 30 days before trip departure, a $50 late sign up fee (per residence) will be assessed to cover express delivery, telephone, fax and administrative charges necessary to expedite your reservation and transmit your trip materials.
If you must cancel your trip, you must do so in writing. We will not accept cancellations made by e-mail. Any applicable refunds will be returned to you in the manner in which payment was made, and processed within 30 days of receipt of your cancellation.
Cancellation at 61 days or more prior to trip departure will result in the forfeit of your deposit.
Cancellation after final payment is made and less than 61 days prior to departure will result in the loss of between 80% and 100% of the trip cost.
We strongly recommend you purchase travel protection.
If you are a no-show, if you cancel your trip after the trip departure date, or if you leave a trip already in progress, you will not receive any refund for any unused portion of your trip. Trip Departure is defined as the date your land trip begins as indicated on our Trip itinerary. Cancellation fees are based on the date your written notification is received at EPA, LLC.

EPA, LLC is not arranging for the purchasing of your International Airline ticket nor responsible of any aspect for these services. Our booking services includes only the Land and local arrangements and it is your own responsibility to find the best Airfare for your trip, purchase your own airline ticket and arrive to the city where your trip begins and on the trip first day as indicated on our trip itinerary, and during day time. We highly recommend that due to the fact that you are traveling to this destination first time and not being familiar with the local streets, culture and life that you will use the pre arranged Airport transportation services we offer so you can be awaited at the airport by our local representative and be escorted to your hotel.

If you make changes to your reservation that affect arriving city, post-trip extensions, local reservation categories or passport name changes between 60 and 30 days prior to departure, an administrative charge of $50 per person will apply. Operator cannot accept any changes to reservations within 30 days of trip departure. If you make changes to your trip departure date, it will be treated as a cancellation and the relevant cancellation charges will apply. Traveler substitutions are considered reservation cancellations and are subject to the above cancellation charges.
In certain circumstances, Operator may change the departure date of your trip or consolidate any trips that do not reach a minimum level of participation or are overbooked. In this event, you will be offered an alternative departure date or trip. If we are not able to agree upon a suitable alternative, you will be entitled to cancel your reservation and receive a full refund of your Trip Price plus any cost you paid for the Travel Protection Plan.
Operator reserves the right to cancel or shorten a trip without notice, in which event your sole remedy shall be a prorated refund for any unused portion of the trip.

Due to many factors beyond our control we reserve the right to change our prices without prior notice, even after you have signed up. However, we do our best to avoid increasing prices without advance notice. Normal price increases generally are not passed on to participants who have already advanced a deposit and do not apply to those who have pre-paid the full cost of the trip prior to the cost increase going into effect.
Normally, we include the cost of all guides, leaders, entrance fees, permits, accommodations, transportation, and most meals as stated in the planned itinerary [B-Breakfast, L-Lunch, D-Dinner]. Vegetarian and special diets can usually be accommodated. The land cost includes profit and charges incurred by EPA, LLC for research, itinerary development, reservations, office administration and pre-departure information services. Quoted costs represent a complete package price; itemized individual costs are not available.
Costs not included in the price are some meals as noted in the trip itinerary, transfers if not arriving or departing on the scheduled group flights, soft drinks and liquor, medical expenses, costs of hospitalization or evacuation, laundry, airport departure taxes, visas, international airfares, gratuities and insurance. If a trip must be extended or an itinerary modified due to weather, road conditions, lack of transportation, political or civil disputes, medical emergency or other causes beyond our control, the associated costs including any nonrecoverable costs are not included in the trip rates or refunds. In such circumstances it is your responsibility to pay directly for actual extra costs in the field (i.e. food, transport, accommodations, etc.). Carry extra traveler’s checks and credit card for contingencies and obtain trip cancellation/interruption insurance.

Custom independent travel requires a $100 non-refundable trip planning fee for itinerary development and quotation which is credited to the final trip cost. Some hotels and lodges and local aviation services require extra deposits at the time of booking to hold space.

We strive to provide you with lodgings that give you a sense of the local culture, and we count on the fact that with your sense of adventure you will welcome the unusual accommodations we provide. Because we travel in small groups, we can stay in more authentic, unique accommodations than larger groups can. Lodging might be quite small, trading size and scale for authenticity and tradition. Some may even be family run, some in thatched-roof cabins and some would be under the sky in tents we provide. Be prepared to share your accommodation with your trip pals. Amenities may not be what you expect from a hotel in the USA. In the rural areas of Ecuador our lodging is limited in services. Water temperature and water pressure may vary and bed size may vary as well.
On our jungle trekking and camping expedition, tents, hammocks, kitchen gear are provided as well as Baggage and gear porters and a local cook accompany the Jungle Expedition. We also provide Mountain bikes, white water rafting and repelling gears.
Participants must furnish their own clothing, and personal gear, day pack, sleeping bags and duffel bag. Operator reserves the right to substitute equivalent hotels in the highland parts of the trip.

Single supplement might be only available in the highlands of the trip and require additional cost of a single traveler not sharing a room in double occupancy. If you request single accommodations you will be charged the single supplement. If you are willing to share a room we will attempt to match you with another traveler of the same gender, in which case the single supplement will be waived. However, if we are unable to find another traveler with whom you can share a room in most cases you will be charged the single supplement.

U.S. Citizens traveling outside the United States are required to carry documentation of U.S. citizenship, such as a passport, valid for six months after your reentry to the US. It is your responsibility to obtain proper documentation. If you are not a U.S. Citizen, contact the embassy, consulate or national airline of the country you are traveling to for entry requirements.
Upon registration to our trip you will be asked to submit us with 2 colored copies of your passport information pages to include your name, photo, passport number and passport validation date, as we are required to submit it in advance to the regional Airport administration and prior to your flight to the Amazon jungle. Please send the two passport copies via mail or scanned and send via email to be received at our office not later then 30 days prior to your trip departure date.
Yellow Fever in Ecuador’s Amazon region is not a risk, but to avoid the disease getting started the Ecuadorian government made it mandatory for all people who enter the Amazon region to have a yellow fever vaccination certificate. It is mandatory to bring the vaccination certificate or a color copy of it with you. We ask that you send one color copy of the certificate to us as well together with the passport copies. Good physical and mental health is essential for the enjoyment of these active, outdoor trip. You will travel in rugged areas removed from modern medical facilities. Good physical conditioning is recommended as preparation for all trips, especially those involving trekking. By forwarding the deposit and signed Reservation Form, the passenger certifies that he/she does not have any physical or other condition of disability that would create a hazard for him/herself or other travelers and/or jeopardize the trip enjoinment of the co travelers of same trip. It is essential that any participant with a medical condition requiring regular treatment or which may be affected by vigorous activity, high altitude, heat, cold, other natural phenomenon, or particular foods, notifies the EPA, LLC and the trip leaders, in writing in advance of travel. EPA, LLC. assumes no liability for medical care nor for special dietary requirements. Participants may be required to furnish a doctor’s statement of good health. The judgment of EPA, LLC or the local operator or guide, shall make the ultimate determination of an individual trip participant's fitness to embark upon, or to continue a trip.
Operator reserves the right to decline or cancel your reservation and/or to deny participation, and/or to remove a passenger from a trip in progress to anyone whom it deems unsuitable for a trip if Operator reasonably determines your condition would adversely affect the health, safety, or enjoyment of you or of other participants. If Operator removes you from a trip in progress pursuant to this paragraph, you will not be entitled to any refund of your Trip Price and Operator shall have no further liability. Once a trip has been confirmed medical circumstances will not be considered as exceptions to our cancellation policy. All participants must be covered by a current medical insurance policy applicable for overseas travel for the duration of their trip. Proof of coverage may be required.
Our X-treme Challenge Expedition adventure is not wheelchair-accessible nor suitable for pregnant women and cannot accommodate service pets.
If you have a condition as contemplated herein and you chose to attend the trip despite all of the above, you travel at your own risk. Operator is not liable for any injuries or damages you may suffer relating to such a condition, including without limitation loss of special equipment, lack of assistance with or accommodation of special needs, and unavailability of medical assistance or treatment.
Operator is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is Operator responsible for the quality of medical care, or lack thereof, you may receive while on the trip.

During this trip we do a fair amount of extreme expeditions, some of hiking 10 miles a day in dense jungle, mainly over rough terrain. We run challenging sport activities, climbing mountains and descending waterfall canyons, some of over 100 feet high (equal to a 10 story building). We also canoe primitive dugout canoes, ride white water rafting, off-road mountain biking, flying small airplanes and more. Many of the paths we take are uneven and at times are covered in water and slippery mud. We often run these activities under tropical rain and high humidity.
Throughout our jungle expedition in particular, we go together as one group on a continuing path without the ability of returning back to a previous transition camp-site or back to our Eco-Planet campground. Therefore, for the safety and well being of one as all, it is expected that you will be able to keep with the pace of the group.
Training ahead as preparation for such expedition and routinely outdoor related challenging sport activities are some of the main components for your success and satisfaction of this adventure as well as of your fellow’ adventurers.
Mental endurance ability is also required in order to achieve such an extreme challenge adventure and we count on the fact that with your sense of adventure, you will welcome any unusual situations you will find yourself in, and always will be prepared with a good spirit to expect the unexpected.
For this adventure to be right for you, you should consider yourself in excellent health, fitness and shape
In saying all of the above we do have some general limitations that may apply to certain persons. These facts might unfortunately disqualify one from participating in our trip:
- In order be able to endure the physical exertion of this X-treme Challenge Expedition and to be qualified for the trip, you will be required to fit our formula criteria of no more then the ‘Normal weight’ = 18.5-24.9 based on the following Body mass index (BMI) which is a measure of body fat based on height and weight that applies to both adult men and women: http://www.nhlbisupport.com/bmi/
- Our X-treme Challenge Expedition adventure is not fitted for pregnant women, respiratory pre condition - such asthma, major disability, nor is wheelchair accessible.
- Minimum age to participate in such adventure is 18 years old.
- This trip is only for non-smoking persons.
I attest herein that I have read the above and that I fully understand and am aware of the trip’s endurance level and of the physical exertion involve in participating in the EPA’s X-treme Challenge Jungle Expedition trip, and of its limitations and requirements and that I am in excellent health, fitness and shape and fit to meet all the trip’s challenges.

By forwarding the deposit and signed Reservation Form, the traveler certifies that he / she have carefully read and fully understand the contents of the RELEASE OF LIABILITY, WAIVER OF CLAIM, EXPRESS ASSUMPTION OF ALL RISKS AND IDEMNITY AGREEMENT which copy of it enclosed here and ready to download, print and sign. The traveler understand this is a legally binding and enforceable contract and is aware of its legal consequences, and have signed it freely and voluntarily, without any inducement, assurance, or guarantees that have been made to him / her, and is intend his/her signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

The responsibility of Eco Planet Adventure LLC and its affiliated companies is strictly limited. As a tour operator, Operator organizes, promotes, and sells tour programs consisting of certain travel services, including surface, air, and water transportation, sightseeing excursions, and cruise/hotel accommodations that Operator purchases or reserves from various suppliers (collectively, “Suppliers”). Operator does not own or operate any of these Suppliers. The Suppliers providing travel services for Operator’s tour programs are independent contractors, and are not agents or employees of Operator. As such, Operator is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. Some tours include visits to shops and merchants. Operator is not responsible for any purchases you make during your trip, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither Operator nor any representative of Operator shall be liable.
Without limitation, Operator is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from—but not limited to—acts of God or force Majuro, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations (except as expressly set forth herein), mechanical or other failure of airplanes or other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the direct control of Operator.
To the extent that Operator is involved in booking air transportation for you, Operator acts as an agent of the air carrier and not as your agent. For all other purposes, Operator does not act as an agent for any party whatsoever.
Operator reserves the right to decline to accept or retain any person as a member of any trip. Except as discussed above in “Medical Issues” your sole remedy shall be a prorated refund of your Trip Price for any unused portion of the trip.
Operator reserves the right to modify itineraries and substitute hotels and accommodations. Included features may not be available for all departures.
California law requires certain sellers of travel to have a trust account or bond. This business has a trust account. This business is not a participant in the California Travel Consumer Restitution Corporation.

This relationship shall be governed by the laws of the Commonwealth of Florida without regard to conflicts of laws principles. For any dispute or claims against Operator the exclusive place of court jurisdiction must be Orange County, in the State of Florida, to the exclusion of the Courts of any other state and country. Any action for damages, whether arising from contract, tort, or otherwise must be brought within one year from the date of departure, or else shall be irrevocably waived.
In no event shall Operator be liable for any indirect, consequential, punitive, multiple, incidental, special or exemplary damages, however caused, and whether in contract, tort or under any other theory of liability, and regardless of whether Operator has been advised of the possibility of such damages. Notwithstanding the foregoing, Operator’s liability for damages hereunder shall in no event exceed the amount actually paid by you to Operator for the trip giving rise to the claim. The foregoing limitation of liability shall not apply to liability for death or personal injury to the extent applicable law prohibits such limitation.
